My final Major project uses clips from a range of sources some of which materials are copyrighted.
The song-
When it comes to music it seems to be that a piece of music can be used for free until the original producer of the song copyright protects it. In the case of the song Weightless that I am planning to use in my piece the band that produced the song are signed to the label Just Music who have copyrighted the track for them. In this situation I would normally have to apply for a copyright license by contacting the label and paying a fee to use the track. I am not however making profit from my piece and therefore my use of the song could fall under the fair use law. Fair use states that
'The purpose and character of the use, including whether the use is of a commercial nature or is for nonprofit educational purposes;
The nature of the copyrighted work, such as whether the work is fiction or non-fiction, published or unpublished;
The amount of the work used in relation to the copyrighted work as a whole, such as using a poem in its entirety, or using one chapter from a long book;
The effect of the use upon the potential market for the copyrighted work.' (Baylor University,2020)
Although I do feel like I meet this criteria I am going to contact the label just to make sure that it is okay to use the track for my piece.
BBC news clips-
As well as the song I also used a number of BBC news clips in my art piece. All of the content the BBC put out is copyrighted and you would you usually have to request permission from the BBC to use any of their content. I thought I would be covered by the Universities ERA license which permits the use of most BBC clips for educational purposes. I however am mainly distributing my piece on YouTube and the ERA license doesn't allow the posting of any of the content covered by it to any social media platform. Again because I am only using short clips and my piece is non profit I could argue Fair use however again I am going to contact the BBC to make sure.
